Term and Conditions
Terms and conditions between 1LineArt Studio and their customers. On the web, this document is often also called “Terms of Service” (ToS), “Terms of Use“, EULA (“End-User License Agreement”), “General Conditions” or “Legal Notes”. These are the standard terms that will govern our professional services agreement for design the project. Please review the terms carefully. If any provision is unclear or requires modification to suit your particular needs, please let us know in advance of commencing services so that we may discuss appropriate alternatives. These Terms and Conditions apply to all photo, graphic, video and associated audio product created by 1LineArt Studio, including all moving and still images and sound recordings of whatever form.
- 1. Scope and Application
These Terms and Conditions apply to all design, video, photography, and post-production services provided by 1LineArt Studio. By engaging 1LineArt Studio’s services, the client agrees to comply with the terms outlined below. Please review carefully and contact us if any provisions need clarification or modification before work begins. - 2. Ownership and File Delivery
Final Deliverables: 1LineArt Studio will supply print files as high-resolution PDFs with crop marks and bleed unless otherwise specified. Clients should clarify any specific file format requirements during the quotation process.
Original Artwork and Source Files: Unless explicitly agreed otherwise, all original artwork and source files remain the property of 1LineArt Studio. If requested, these files can be purchased for an additional fee.
Usage Restrictions: Supplied designs are for the client’s intended use only and must not be altered or repurposed without prior consent. - 3. Responsibility for Final Approval
Proofing: 1LineArt Studio takes reasonable care to avoid errors but is not responsible for any errors, including typographical, spelling, or grammatical mistakes in the final product. It is the client's responsibility to thoroughly review proofs and provide approval in writing before the final product is released.
Post-Approval Changes: Any changes required after client approval will incur additional fees to cover the design time. - 4. Project Cancellation
Cancellation Policy: Either party may cancel the project at any time, with written notice required for cancellation. If cancellation occurs after the design process has commenced, 50% of the initial deposit is non-refundable. - 5. Color Accuracy
Color Variation: Due to differences between screen displays (RGB) and printed materials (CMYK), color variations may occur. 1LineArt Studio is not liable for such variations, as they are beyond our control. - 6. Client Material Usage
Ownership of Design Concepts: Any design concepts provided to the client during the project remain the property of 1LineArt Studio and may not be reproduced or shared publicly (e.g., social media) without prior permission.
Ownership of Final Design: Upon full payment, the client owns the final approved design. This excludes working files, which remain the property of 1LineArt Studio. - 7. Payment and Pricing
Deposit: A 50% non-refundable deposit is required before work begins. An invoice for the deposit and the remaining balance will be provided, and final deliverables will be released upon full payment.
Late Payments: If the client remains uncontactable for 30 days, 1LineArt Studio reserves the right to invoice the full remaining balance. 1LineArt Studio also reserves the right to pursue collection processes for accounts unpaid for more than 30 days. - 8. Video Production Terms
Creative Judgment: 1LineArt Studio will create visually appealing videos but cannot guarantee exact color matching or specific outcomes. Retouching, digital manipulation, and other artistic effects are available upon request for an additional fee.
Additional Revisions: Any changes requested beyond the agreed scope of work may incur additional fees, including variations or additional copies of the video on DVDs or memory sticks.
- 9. Music Rights
Client-Supplied Music: Clients are responsible for securing appropriate licenses for any music they provide. The client agrees to indemnify 1LineArt Studio against any penalties resulting from the use of client-provided music.
1LineArt Studio-Supplied Music: 1LineArt Studio will obtain the necessary rights for any music it supplies. The client may only use the music within the context of the final video and not for any other purpose. - 10. Post-Production Revisions
Rounds of Amendments: The client is entitled to up to three rounds of reasonable revisions within the scope of the project. Additional revisions or changes beyond the original scope will incur extra charges at the studio’s current rates.
Client Feedback: Clients must provide clear and consolidated feedback from all stakeholders promptly after each round of revisions. Delays in providing feedback may impact the project timeline and result in additional charges. - 11. Project Timeline and Delivery
Timeline: A project timeline with key milestones will be agreed upon in writing before work begins. 1LineArt Studio will work to meet the agreed deadlines, but unforeseen delays may occur. Clients are responsible for providing feedback and required materials on time to avoid delays.
Final Delivery: Upon project completion, the final deliverables will be sent to the client. The project is considered closed upon client sign-off. - 12. Copyright and Usage License
Client Materials: The client is responsible for ensuring all materials provided to 1LineArt Studio (logos, images, audio, etc.) comply with copyright laws. The client indemnifies 1LineArt Studio from any legal issues related to copyright infringement.
1LineArt Studio Ownership: 1LineArt Studio retains full copyright over all created content, but a usage license is granted to the client for the final project. This license allows the client to use the content in its delivered form only and prohibits any alterations without express written permission.
Promotional Use: 1LineArt Studio reserves the right to use client projects in its portfolio, showreels, or other promotional activities unless otherwise agreed upon in writing. - 13. Watermark
1LineArt Studio reserves the right to add a watermark to content it produces. Removal of the watermark requires prior written consent and may incur an additional fee. - 14. Backup and Storage Service
Optional Backup Service: Clients may opt for secure backup and storage of project files for an additional fee (10% of the project cost) for one year. After one year, clients can renew the service for an additional fee or the files will be deleted.
Data Deletion: If the storage service is not renewed, files will be permanently deleted to free up storage space. - 15. Communication
